A federal judge has ruled to allow a lawsuit filed by the family of a teenager who committed suicide after taking the antidepressant drug Paxil. The judge found that the lawsuit was not pre-empted by Food and Drug Administration rules governing the drug at the time of the 2002 suicide. Rather, the judge found a jury must decide whether the drug manufacturer had information indicating that the drug could increase the risk of suicidality in teens and adolescents. Law.com
